The AUC has not approved changes to the legislation on potable water supply

The Ministry of Regional Development sent to the AUC the Draft Law “On Amending the Law of Ukraine “On Potable Water and Water Supply”.  The purpose of the draft document is to improve the legal regulation of the relation between the providers of potable water supply services and their customers.

In particular, the Draft Law suggests the following:

- have the law cover sewage services as well;

- impose a ban on the privatisation of outdoor water supply and sewage networks, which are owned by the state or by a territorial community.

In the AUC opinion, these provisions do not raise any concerns.

However, the AUC does not agree to concur with the following amendments:

- excluding from the document the provisions establishing the rights and obligations of customers and service providers;

- introducing potable water purchase contracts or purchase contracts for housing and utility services.  

In the opinion of the AUC Analytical Center, such changes do not seem to be well justified and can offer an ambiguous interpretation. The Association has suggested the Ministry of Regional Development to retain the provisions outlining the rights and obligations of potable water customers and potable water supply companies in the current version of the Law.
