FEBRUARY 16, V.Parkhomenko, AUC Analytical Center Director, and V.Kravchenko, Director of the AUC City Legal Assistance Center, took part in the regular meeting of the working group to prepare the Draft Law “On Administrative Services” (#9435) for the second reading. The document was submitted for consideration by the President of Ukraine and was approved by the parliament in the first reading on December 09, 2011.
In particular, the working group discussed the Draft Law “On Amending Certain Laws of Ukraine Concerning Administrative Services” (#8671) prepared by the Cabinet of Ministers.
The purpose of the draft law is to prepare the legal framework for the commercial administrative services rendered by the Ministry of Justice and the State Registration Service of Ukraine. The document, in particular, envisions the introduction of a mandatory payment for the registration of Territorial Community Charters.
The AUC categorically rejects this proposal. By their nature, territorial community charters are considered to be legal and regulatory documents and their registration in Ukraine should not require any payments.
In addition to this, the AUC experts share the opinion that the adoption of this law will lead to the additional burden on local budgets. Consequently, territorial communities will give up the idea of adopting their charters and the principle of the organisational autonomy of territorial communities will be ignored.
