Draft law to regulate issues of displacing residents during the repairs of residential buildings

The Ministry of Regional development sent to the Association of Ukrainian Cities the Draft Law “On Amending Article 13 of the Law of Ukraine “On Integrated Reconstruction of Quarters (residential districts) with the Outdated Housing Stock”.  The purpose of the document is to regulate the problem issues arising in the course of displacing residents of residential quarters with outdated housing stock, which is subject to the reconstruction works.

In particular, the Draft Law envisions the following: in case more than 60 percent of owners of the building have agreed to being displaced, the other owners can be forced to displacement by the court decision, whereas their housing can be bought out at market prices.  

The AUC has concurred with this Draft Law provided their proposal is included: in case the owner of the apartment does not want to be displaced of his own free will (the court has made the corresponding decision), he/she should have the right to choose either to sell the apartment at the market price or obtain an equal housing.
