FEBRUARY 13, the web-site of the Verkhovna Rada of Ukraine published the Draft Law “On Local and Regional Self-Governance of Ukraine” (#10025). The purpose of the document is to ensure the implementation of the European Charter of Local Self-Governance and to create conditions for the proper development of local and regional self-governance.
In particular, the document gives the right to rayon and oblast councils to set up their own executive bodies, thus limiting the authority of local state administrations. However, in the opinion of the AUC experts, these provisions require the corresponding amendments to the Constitution of Ukraine.
The Draft Law also envisions no responsibility of local governments for their failure to implement the authority delegated by the central government in case the State Budget does not support the corresponding expenditures from local budgets.
In the opinion of the AUC Analytical Center, the Drat Law needs further elaboration despite some of its progressive provisions.
