New draft law to regulate the delineation of boundaries between state-owned and communally-owned schools

FEBRUARY 13, the parliament registered the Draft Law “On Amending Certain Ukrainian Legislation Concerning the Delineation of Boundaries between State-Owned and Communally-Owned Lands” (#10043).

The document offers a mechanism for the automatic delineation of boundaries between state-owned and communally-owned lands according to the clear criteria, such as:

  • communally-owned lands – all lands within the boundaries of villages, towns and cities, except for land plots permanently owned by the state executive agencies, state-owned enterprises, institutions and organisations; a well as land plots where state-owned immovable property items are located;
  • state-owned lands – all other lands, except for the communally-owned lands.

In addition to this, the draft law provides an opportunity for local governments to include into communal ownership the lands located beyond populated areas whose purpose is to provide services to territorial communities (cemeteries, land fills, etc.). The current legislation does not envision such an opportunity.

In addition to this, the Draft Law does not envision local budget expenditures to prepare the delineation document packages.
