Ukraine’s Constitution attributes to the local self-governance authority the following: municipal property management, adoption of local budgets and social/economic and cultural development programs, surveillance over their realisation, establishment of local taxes and duties, creation of municipal enterprises, conducting local referenda and other local level issues. This authority is specified in detail in the law “On Local Self-Governance in Ukraine”.

Major part of the local self-governance authority is performed via representational local self-governance bodies and their executive entities.

In terms of their structure the local self-governance body authority comprises:

  • Proper (self-government) authority whose execution is related to settling local-level matters, providing civil services to population;
  • Delegated authority – individual authority of the executive power bodies legally entrusted to the local self-governance bodies to observe the subsidiarity principle.

The Law of Ukraine “On Local Self-Governance in Ukraine” provides detailed specifics of the local self-governance authority in the following areas and trades:

Social-economic and cultural development; planning and registration.

  • Ensuring a balanced economic and social development of a given territory, efficient use of natural, labour and financial resources.
  • Development and implementation of the social/economic and cultural development programs for villages, towns and cities.

Budget, finance and prices

  • Adoption of local budget and ensuring its implementation.
  • Setting tariffs for household, utility, transport and other services.
  • Facilitating in investment activities on the given territory.

Municipal property management

  • Managing territorial communities’ municipal property; disposal of property; leasing concession.

Housing and municipal economy, household and commercial services, public catering, transportation and communication.

  • Supplying energy and water to population; wastewater and water treatment; monitoring potable water quality.
  • Improvement of populated areas, arrangement of green spaces, creating recreational zones.
  • Collection and utilization of domestic waste.
  • Facilitating in setting up condominium associations and their registration.
  • Adoption of public transportation time schedules and itineraries.

Civil construction

  • Construction, overhaul, refurbishment of social and cultural objects, municipal economy structures, residential buildings and local roads.
  • Adoption of city development programs and territorial master plans.

Education, public health, culture, physical culture and sports

  • Ensuring full general secondary education; arranging for child upbringing, youth development, their individual progress; facilitating in operation of pre-school and out-of-school educational and training institutions, child, youth and academic organizations;
  • Ensuring accessible and free of charge education and medical services on the pertinent territory; opportunities to study at school in the national and native language.

Settling land relations and environmental protection

  • Charging land fees;
  • Granting local community’s land for development and for other purposes;
  • Maintaining control over observing land and environmental legislation, use and protection of land, natural resources of national and local significance, reforestation.

Social protection of population

  • Assistance to the disabled, war veterans, other unprotected strata of population in construction of residential buildings, capital repairs, procurement of construction materials, allocation of land parcels to natural persons.
